قد تواجه برزي ذات الثلاثة و الستين عاماً حكماً بالإعدام بتهمة الاختطاف و حماً يصل لخمسة عشر عاماً. لا يقول ويليامز ما إذا كانت بارزي ستحصل على حكم مخفف كجزء من اتفاقية مع القضاة الفدراليين كمقابل للاعتراف بالجريمة.
رفضت ميلودي ريدالك متحدثة باسم مكتب محامي الولايات المتحدة في يوتا التعليق على الاتفاق.
كانت سمارت في الرابعة عشرة حين تم اختطافها عام 2002 من غرفة نومها تحت تهديد السكين و أخذها بهدوء شديد إلى مخيم عند الجبال خلف منزلها في مدينة سالت ليك. تم استرجاعها في أشهر لاحقة بعد أن شاهدها شخص يستقل سيارة و هي تمشي في شارع فرعي مع برزي و زوج برزي المبعد حالياً، براين ديفد ميشل.
. و قد حصل دور بيرزي في الاختطاف المزعوم اهتماماً أقل من دور ميشل.
قالت سمارت في جلسة استماع الشهر الماضي إن ميشل قام خلال ساعات من اختطافها بأخذها على أنها زوجته الثانية و من ثم الاعتداء عليها. قالت سمارت إن بارزي غسلت قدمي المراهقة و ألبستها ثوباً استعداداً للحفلة.
شعرت بارزي بالتضايق غالباً بسبب علاقة ميشل بسمارت و لكن العاطفة لا تستمر على أية حال، كما تقول سمارت.
سجلت قضايا الدولة في مارس 2003 تهماً ضد بارزي و ميشل و لكنها عرقلت بأحكام غير مناسبة للمحاكمة.تم توجيه الاتهام لبارزي وميشل من قبل هيئة المحلفين الكبرى الفدرالية مارس 2008.
جاء اعتراف بارزي بعد شهر من تقرير من مستشفى يوتاه موجه لقاضي دولة يفيد بأن بارزي استعاد قدراتها بعد خمسة عشر شهراً من علاجات وفقاً لأوامر المحكمة إضافة لأدوية ضد الأمراض النفسية.
" لن تطرح قضايا عن القدرات العقلية في ساحة المحكمة الفدرالية،" أخبر ويليامز الأسوشياتد برس الإثنين.
و قد وجد ميشل أيضاً في وضع غير مناسب للمثول في المحكمة. حيث رفض قاض خضوعه لأدوية بشكل قسري.
و يتعين على ميشل أن يمثل يوم 30 تشرين الثاني في جلسة استماع تمتد مدة عشرة أيام في قضيته الفدرالية.
يقول المدعون إن الطبيب النفسي الذي قيم ميشل يؤكد بأنه يبالغ في الأعراض حتى يتلافى الدعوى القضائية.

SALT LAKE CITY – One of two people charged in the 2002 abduction of Elizabeth Smart has pleaded guilty to federal charges.
In a deal with prosecutors, Wanda Eileen Barzee pleaded guilty to charges of kidnapping and unlawful transportation of a minor Tuesday in U.S. District Court in Salt Lake City.
The 64-year-old Barzee could face a life sentence for the kidnapping charge and up to 15 years for the other count. It's unclear whether she may get a reduced sentence in exchange for her plea.
Smart was 14 when she was taken at knifepoint from the bedroom of her Salt Lake City home, sparking a search that riveted the nation. Nine months later, in March 2003, Barzee and Brian David Mitchell were arrested they were spotted walking on a suburban street with Smart.

SALT LAKE CITY (AP) — Seven years after it began, the wrenching saga of Elizabeth Smart's kidnapping is expected to move toward resolution Tuesday with an expected guilty plea from one of the two defendants charged in the case.
Wanda Eileen Barzee is scheduled to appear in Utah's U.S. District Court on Tuesday to enter the plea on charges of kidnapping and unlawful transportation of a minor, her attorney Scott Williams said Monday.
Barzee, 63, could face a life sentence for the kidnapping charge and up to 15 years on the other count. Williams would not say whether a reduced sentence was part of a deal cut with federal prosecutors in exchange for a the plea.
Melodie Rydalch, spokeswoman for Utah's U.S. attorney's office, declined to comment on the agreement.
Smart was 14 in 2002 when she was abducted from her bedroom at knifepoint and whisked away to a campsite in the mountains above her Salt Lake City home. She was recovered nine months later after a motorist saw her walking on a suburban street with Barzee and Barzee's now-estranged husband, Brian David Mitchell.
Barzee's role in the alleged abduction has garnered less attention than Mitchell's.
At a hearing last month, Smart said that within hours of the abduction, Mitchell took her as a polygamous wife and then raped her. Smart said Barzee washed the teen's feet and dressed her in robes before the ceremony.
Barzee often became upset over Mitchell's relationship with Smart, but that sentiment would never last, Smart said.
State cases filed in March 2003 against Barzee and Mitchell have been stymied by rulings that both were incompetent for trial. Barzee and Mitchell were indicted by a federal grand jury in March 2008.
Barzee's plea comes a month after a Utah State Hospital report to a state judge said that 15 months of court-ordered treatments with anti-psychotic medications had restored her competency.
"No issues of competency will be raised in the federal court matter," Williams told The Associated Press on Monday.
Mitchell has also been found incompetent for trial in state court. A judge refused to order him to undergo forced medications.
On Nov. 30, Mitchell is scheduled for a 10-day competency hearing in his federal court case.
Prosecutors claim that a psychiatrist who evaluated Mitchell contends he is exaggerating or faking psychiatric symptoms to avoid prosecution.
